		<description><![CDATA[事業單位一定要訂定  [ 工作規則 ] ？ 2010/2/17 下午 09:10:23 回上一頁 1.事業單位一定要訂定 [工作規則]？  2.訂定[工作規則]會使得人事運作缺乏   彈性與受限？   常有企業疑慮若依規定訂定[工作規則]是否會使得人事 運作缺乏彈性，造成管理制度上的受限與僵化？   本公司顧問認為 : 其實企業訂定 [工作規則 ] 好處多多， 不僅長遠建立公司內部之人事制度，維護良善管理秩序 ，又能樹立良好企業資方形象，遇勞資爭議申訴案件發 生時，亦避免勞工於不明指控下受主管機關責備。另依 據勞基法第70條規定，雇主僱用勞工人數在30人以上者 ，均應訂立工作規則（強制規定）。至於僱用勞工30人 以下之事業單位雖然無強制；但本公司顧問建議應比照 前項最好訂立工作規則，函請主管機關核備存檔，於內 部公告揭示或製發員工手冊週知，建立共識。   而工作規則訂定後，是否會使得事業單位缺乏運作彈性， 造成管理制度上的受限與僵化？其實不會，因工作規則之 內容係雇主依其事業性質所訂定之內部重要管理規章，舉 凡影響勞工勞動條件之具有一定「重要性」及「持續性」 屬法律必要事項如勞工之任用、出勤、工時、工資、請假 、休假、離職等都應明細規範。而為兼顧公司經營管理運 作之彈性，具不定期變動的項目，如薪資策略、發放辦法 、調薪幅度、年終獎金、紅利發放之數額與約定或標準等 ，又如教育訓練、服務規章、員工福利（婚喪喜慶等）、 或其他優於勞動基準法之相關勞動條件等，應可視企業勞 務經營做不定期檢討或變動。只要操作適法得宜，如此不 &#8230; <a href="http://blog.rootlaw.com.tw/tracy/2010/02/17/%e4%ba%8b%e6%a5%ad%e5%96%ae%e4%bd%8d%e4%b8%80%e5%ae%9a%e8%a6%81%e8%a8%82%e5%ae%9a-%e5%b7%a5%e4%bd%9c%e8%a6%8f%e5%89%87-%ef%bc%9f/">繼續閱讀 <span class="meta-nav">&#8594;</span></a>]]></description>
